Arctelia — Terms and Conditions

By creating an account or using Arctelia, you agree to the following terms. These terms are written in plain language and are intended to be understood without a law degree. If we update these terms, we will notify registered users by email before changes take effect.

1. What Arctelia Is

Arctelia is a creative practice tracking tool. It helps you log, reflect on, and maintain continuity across your creative work. Arctelia uses artificial intelligence to provide reflective guidance based on your entries and artifacts. Arctelia does not generate creative work on your behalf — no images, no prose, no music, no code. The craft stays in your hands.

2. Your Account

You are responsible for maintaining the security of your account credentials. One account per person. Accounts are not transferable. You must be at least 16 years of age to use Arctelia. We reserve the right to suspend or terminate accounts that violate these terms.

3. Your Content

Everything you create and upload to Arctelia — entries, notes, images, recordings, artifacts — belongs to you. You retain full ownership of your content at all times. By publishing content to the Gallery, you grant Arctelia a limited, non-exclusive license to display that content within the Gallery feature for other users to view. This license ends when you remove the content from the Gallery or delete your account.

You are responsible for ensuring you have the right to upload any content you submit. Do not upload content you do not own or do not have permission to use.

4. Content Standards — Gallery and Public Features

Explicit material is defined as content that is pornographic, overtly sexual in nature, or depicts graphic violence intended to shock, disturb, or glorify harm.

5. Praise and Community Conduct

The Praise feature exists to encourage fellow practitioners and acknowledge their craft. Praise is meant to be positive recognition of creative work — not a venue for unsolicited critique, correction, or commentary on the practitioner rather than the work.

Violations of community conduct standards may result in:

  1. A warning and removal of the offending content
  2. Temporary suspension of Gallery and Praise privileges
  3. Permanent ban from Arctelia

We will review reported conduct in good faith and make reasonable efforts to contact the user before taking permanent action, except in cases of severe or repeated violations.

6. Data Practices

6.1 We Do Not Sell Your Data

Arctelia does not sell, license, trade, or otherwise provide your personal information or content to third parties for commercial purposes. We will never sell your data. This is a core commitment, not a policy that changes with business conditions.

6.2 How Your Data Is Used

Your entries, artifacts, and account information are used solely to provide Arctelia's services to you. This includes:

Your entries and artifacts are processed by third-party AI models (including but not limited to models provided by Anthropic, OpenAI, and Google) to generate guidance, synthesis, and image/audio/video analysis. This processing occurs on a per-request basis. We do not provide your content to AI providers for the purpose of training their models. We do not use your content to train our own models.

6.4 Third-Party Services

Arctelia uses third-party services for infrastructure, authentication, payment processing, and AI capabilities. These services receive only the information necessary to perform their function. We select providers with strong privacy practices, but we cannot guarantee the security practices of third parties.

7. Data Storage and Loss

7.1 Arctelia Is Not a Sole Repository

Arctelia is a creative practice tool, not a backup service or archival system. While we take reasonable measures to maintain the integrity and availability of your data, we strongly encourage you to use the Compile and Export features to regularly back up any content that is valuable to you.

7.2 No Guarantee of Availability

We make reasonable efforts to keep Arctelia available and your data intact, but we do not guarantee uninterrupted access or permanent storage. Service interruptions, data migration issues, technical failures, or discontinuation of the service may result in temporary or permanent loss of data.

7.3 Limitation of Liability for Data Loss

Arctelia is not responsible for any loss of data, including but not limited to entries, artifacts, images, recordings, or AI-generated guidance and synthesis. We are not liable for the monetary, sentimental, professional, or creative value of any lost content. By using Arctelia, you acknowledge that maintaining your own backups of important work is your responsibility.

8. AI Guidance Disclaimer

AI-generated guidance, synthesis, and analysis provided by Arctelia are reflective tools intended to support your creative practice. They are not professional advice of any kind — not artistic instruction, not medical guidance, not legal counsel, not financial advice.

AI observations about your work may be inaccurate, incomplete, or subjective. You should rely on your own judgment and, where appropriate, consult qualified professionals. Arctelia is not liable for any decisions made based on AI-generated content.

9. Payment and Subscription

9.1 Billing

Paid subscriptions are billed monthly at the rate displayed at the time of purchase. We will notify you of any price changes at least 30 days before they take effect. Price changes do not apply to the current billing cycle.

9.2 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to paid features through the end of the period you have already paid for. Upon cancellation, your account reverts to the free tier. Your data is retained but access to paid features (AI guidance, Compile, advanced exports) is suspended.

9.3 Refunds

We do not offer routine refunds for subscription payments. If you believe you were charged in error or experience a significant service disruption, contact us and we will review your case in good faith.

10. Intellectual Property

10.1 Your Work

You own your content. Arctelia claims no ownership over your entries, artifacts, or any creative work you upload.

10.2 AI-Generated Content

Guidance, synthesis, and analysis generated by AI in response to your entries are provided as part of the service. You may use, export, and share this content freely. Arctelia does not claim ownership over AI-generated responses to your work.

10.3 Arctelia's Property

The Arctelia application, its design, the Glaukos motion system, craft-specific prompt systems, and all associated branding are the intellectual property of Arctelia and its owner. You may not copy, reproduce, or create derivative works of the application or its systems without written permission.

11. Termination

We may terminate or suspend your account if you violate these terms, engage in prohibited conduct, or use Arctelia in a way that harms other users or the service. In cases of termination, we will make reasonable efforts to allow you to export your content before your data is deleted, except where the violation involves illegal content or activity.

You may delete your account at any time. Upon deletion, your data will be permanently removed from our systems within 30 days, with the exception of anonymized, aggregated data that cannot be used to identify you.

12. Limitation of Liability

Arctelia is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that any content will be preserved indefinitely.

To the maximum extent permitted by law, Arctelia and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, loss of creative work, or interruption of creative practice.

Our total liability for any claim arising from your use of Arctelia shall not exceed the amount you paid for the service in the 12 months preceding the claim.

13. Changes to These Terms

We may update these terms from time to time. When we do, we will update the date at the top of this document and notify registered users by email. Continued use of Arctelia after changes take effect constitutes acceptance of the updated terms.

14. Governing Law

These terms are governed by the laws of the Commonwealth of Massachusetts, United States. Any disputes arising from these terms or your use of Arctelia shall be resolved in the courts of Massachusetts.
